It’s not the smoking age that’s set by Federal law, it’s the age at which cigarettes can be sold to a minor, which states have to set at 18 or higher. Some states also set a minimum smoking age, which needn’t be the selling age, but others don’t. Last I was there, New York didn’t — you can smoke at any age.
